How about relying not only on regulations, but also considering Paul Volcker's advice from experience: being too big is itself a problem that can and should be remedied? I've just posted on it at http://euandus3.wordpress.com/2009/10/25/bigger-banks-too-big-to-fail/

You might want to read the article I read: http://www.msnbc.msn.com/id/33477077/ns/business-the_new_york_times/

Fired up! Nice one, JB.

"You fine a Bank of America $15 million, you’re basically taking less than what they spend on pencils. No wonder they learned nothing."

The wrist-rubs (slap is too harsh a description) these guys get from FINRA and others are laughably small. The size of the fines usually doesn't even seem to match the ill-gained profits.

What a great deterrent: "IF you get caught, you MIGHT have to give back your profits from the scam. Don't worry, you won't have to admit any wrongdoing or suffer any criminal charges".
